Washington likely to focus on oversight
The political changes in Congress as a result of the November 2010 elections may affect PJM and its members. The focus of the new Congress could well shift dramatically. For example, the 111th Congress considered extremely ambitious proposals, some of which would have had a negative impact on PJM while others would have been beneficial.
By contrast, the new Congress will be much more focused on oversight, including intensive oversight of the U.S. Environmental Protection Agency, the Department of Energy and agencies charged with implementing the Dodd-Frank financial reform legislation.
Although issues such as cyber security may well lead to legislative proposals, the current Congressional agenda appears to be far more focused on oversight than new ambitious legislative proposals. In any event, PJM will continue to provide relevant information as requested to the new Congress on both the national and local issues that drive Congressional policymakers.

PJM passes stringent audit for 10th consecutive year
PJM Interconnection’s market settlement billing controls passed the stringent SAS (Statement on Auditing Standards) 70 Type 2 audit for the tenth consecutive year.
SAS 70 is an auditing standard developed by the American Institute of Certified Public Accountants to enable an independent auditor to evaluate and issue an opinion about a service organization’s controls. The Type 2 audit that was just completed includes an opinion from the auditor about the adequacy of design of PJM’s controls and the level of compliance with those controls, as well as a description of the auditor’s tests of operating effectiveness.
PricewaterhouseCoopers (PwC) conducted the audit, which covered the 12-month period from Oct. 1, 2009, through Sept. 30, 2010. PwC’s unqualified opinion covered controls related to PJM’s market settlements processes, as well as the information technology infrastructure that supports PJM markets.
In keeping with governance rules, such as those in the Sarbanes-Oxley Act of 2002, a SAS 70 report is designed to provide an understanding of a service organization’s internal controls to the auditors of the companies that use the organization’s services.

First bills issued through PJM Settlement Inc.
Members who transact with PJM will notice a new logo on their billing statements and settling invoices with a different bank account this month as PJM Settlement Inc., the new subsidiary of PJM, assumes the handling of transaction activity for PJM. Other than the new logo, the differences to members in using the new subsidiary will be seamless.
The Federal Energy Regulatory Commission (FERC) approved the new subsidiary Dec. 30, 2010. PJM Settlement Inc, acts as a counterparty to members’ pool transactions and would have a clearly defined legal standing to collect unpaid balances of a member that declares bankruptcy.
The subsidiary issues billing statements, receives and remits payments from members, and manages credit. All members of PJM are automatically members of PJM Settlement Inc., and there are no additional charges to members. (Although there is a rate structure for its services, the fees from PJM Settlement Inc. will “net to zero” when balanced with credits from PJM.)
PJM Settlement Inc., a Pennsylvania nonprofit corporation, has a service agreement with PJM to provide and retain services, including PJM staff support. A new website has been created for the subsidiary at www.pjmsettlement.com.

ISOs/RTOs report performance metrics: Extensive array of grid operation and power market data presented
The independent system operators (ISOs) and regional transmission organizations (RTOs) regulated by the Federal Energy Regulatory Commission (FERC) submitted a metrics report providing extensive data on grid operations and power markets in their regions.
The California Independent System Operator Corporation, ISO New England, Inc., Midwest Independent Transmission System Operator, Inc., New York Independent System Operator (NYISO), PJM Interconnection and Southwest Power Pool, Inc. compiled the report as part of FERC’s efforts to develop standardized measures to track the performance of grid operations and power markets in ISO/RTOs and other regions of the nation.
Prepared at FERC’s request, the report includes more than 50 separate metrics providing information on electric system reliability, wholesale electricity market benefits and the organizational effectiveness of the six ISOs/RTOs under FERC jurisdiction.
“The product of a 16-month collaborative process, this report demonstrates the commitment to transparency in the operations of ISOs/RTOs allowing the public to be more aware of how our industry provides cost-effective services to the more than 170 million consumers in ISO/RTO regions,” said Terry Boston, PJM president and chief executive officer.
The report shows that ISOs/RTOs are operating the grid reliably, administering markets openly and efficiently, advancing public policy energy objectives and enabling demand response and energy efficiency, according to Stephen G. Whitley, president and chief executive officer of the NYISO and chair of the ISO/RTO Council.
The report notes that its data should be viewed in context, given significant differences in the geographic territories served by the ISOs/RTOs, the regional reliability requirements developed for each system, the unique components of market designs, the composition of available power resources and other variables.

PJM files with FERC to expand Demand Response alternatives in capacity market
PJM filed a proposal (PDF) with the Federal Energy Regulatory Commission (FERC) to establish two additional product alternatives for demand resources seeking to participate in PJM’s capacity market: an annual resource product and an extended summer demand resource product. PJM is retaining its existing demand resource product in the capacity market but renaming it Limited Demand Resource.
The PJM filing proposes to implement these revisions for the 2014/2015 delivery year. PJM has requested a FERC decision in time for the February 1, 2011, posting of the planning parameters for the auction.
PJM president and CEO Terry Boston sent a letter to PJM’s members explaining this development and noting that as dependence on demand resources increases, it is important to reform products to ensure that future reliability requirements are met. The full text of Boston’s letter is available (PDF).

PJM launches electric water heater pilot on campus; video available
PJM has a new, fully-functional advanced technology pilot on its campus that shows how thermal storage can participate in PJM’s Energy and Regulation markets. A 105-gallon electric water heater, visible in the entrance of a PJM’s office building, demonstrates the potential to minimize the cost of operation by responding to the PJM’s wholesale price signal and also shows revenue potential by responding to the PJM frequency regulation signal. The water heater also provides the hot water for the building.
PJM worked together with Steffes Inc., which provided the water heater control, and Marathon Water Heaters, which provided the water heater, to install the water heater.
A video display shows a snapshot of the operation and state of the water heater as it responds to the PJM wholesale price signal and frequency regulation signal. It shows the current water temperature, current reserve capacity available to regulate, the water heater’s performance in response to locational marginal price and the water heater’s performance in response to the regulation signal.

West Virginia PSC selects PJM EIS’ GATS to administer renewable portfolio standard program
West Virginia will rely on the Generation Attribute Tracking System (GATS) from PJM Environmental Information Services, Inc. (PJM EIS) to achieve the objectives of its new renewable portfolio standard.
The West Virginia Alternative and Renewable Energy Portfolio Standard Act requires that by 2025 at least 25 percent of the electricity supplied by in-state investor-owned electric utilities and retail suppliers serving more than 30,000 customers must come from eligible alternative and renewable electric resources. Under the law, the Public Service Commission of West Virginia (PSC) is to establish a system of tradable credits to verify and monitor generation of electricity from alternative and renewable resources. The credits can be used to meet the portfolio requirements.
The PSC designated PJM EIS’ Generation Attribute Tracking System to provide the required tracking registry services for each megawatt-hour of electricity. PJM EIS provides environmental and emission attributes tracking services in the mid-Atlantic and Midwest regions and is a wholly-owned subsidiary of PJM Technologies, Inc. PJM Technologies, Inc. is a subsidiary of PJM Interconnection, LLC.
PJM EIS has worked with other states with similar requirements for renewable and alternative energy resources, such as energy efficiency. Since 2005, the GATS has tracked and verified more than 4.2 billion megawatt-hours of electricity.
PJM EIS and the Public Service Commission of West Virginia will announce future training sessions about the program.

PJM employees go the distance for the community
The number “4,744” has special meaning to PJM employees. It is the number of miles that they have walked, run or cycled in support of various community outreach efforts. Their efforts are highlighted in a new section of pjm.com.
Each year, PJM as an organization as well as hundreds of its employees participate in community, civic and health-related projects to enhance and support their communities. Employees also support the advancement of educational and environmental initiatives, such as working with high school students on advanced technology or participating in local recycling projects and hands-on clean-up efforts.
Hundreds of nails have been hammered to fix or build homes and support improvement projects that benefit the community. Hundreds of meals have been donated or prepared for families of sick children and for less fortunate families. Through both company supported and individual activities, employees also have collected books for a school library, recycled materials and batteries, donated clothing and toiletries.
PJM does not have a philanthropic foundation and does not accept solicitations for grants and sponsorships.

On November 12, 2010 in FERC Docket No. RM10-23-000, PJM, on behalf of the ISO/RTO Council (“IRC”), filed Reply Comments in FERC’s rulemaking proceeding concerning Transmission Planning and Cost Allocation. Specifically, the IRC’s reply comments addressed its concerns with comments of others that: (1) confuse the direction, and potentially broaden the scope, of public policies that transmission planning entities are expected to take into consideration in their transmission planning processes; and (2) add an unnecessary layer of oversight, beyond the Commission’s oversight of the transmission planning process.

On November 10, 2010, in Docket Nos. ER11-2074-000 and ER09-1063-000, PJM submitted a compliance filing incorporating revisions, as required by the Commission’s August 12, 2010 Order to incorporate a data posting methodology, add RPM must offer requirement provisions in Section 6.6 of Attachment DD, specify market violations that do not require an IMM referral to FERC and revisions to the normal operations review criteria used by PJM in determining whether to deny an Economic Load Response Participant’s daily settlement submission (Load Reduction for Uneconomic Hours). The Commission assigned a new Docket No. ER11-2074-000 to this filing in order to comply with the Commission’s Order 714 electronic tariff requirements. PJM requests an effective date of November 11, 2010.

As directed by the Commission in Order No. 714, on November 10, 2010, in Docket No. ER11-2061-000, PJM submitted a ministerial filing to incorporate into its baseline electronic tariff the PJM Tariff and Operating Agreement revisions accepted by the Commission on October 19, 2010, in Docket No. ER10-2323-000. This ministerial filing makes no substantive modifications to the PJM Tariff or Operating Agreement. The revisions were originally filed by PJM in Docket No. ER10-2323-000 on August 23, 2010, and were proposed by PJM to apply the balancing Operating Reserves allocation criteria only for intervals where a resource is producing megawatts and to establish that where a resource was running for less than four (4) intervals in an hour, the credits for that resource will be identified as being the same category as identified for the Operating Reserves for the other discrete clock hours. PJM requests that the ministerial revisions be made effective October 25, 2010, the effective date previously approved by the Commission in Docket No. ER10-2323-000.

On November 9, 2010, in Docket No. ER11-2058-000, the Commonwealth Edison Company, on behalf of itself and its wholly-owned subsidiary Commonwealth Edison
Company of Indiana, Inc., (“ComEd”) filed a Transmission Interconnection Upgrade Agreement between ComEd and ATC, pursuant to ATC’s requested that ComEd upgrade certain portions of its transmission. ComEd and ATC entered into an interconnection agreement effective as of April 24, 2010 to govern the interconnection of ComEd and ATC’s respective transmission systems. The Transmission Interconnection Upgrade Agreement establishes the requirements, terms, and conditions for the interconnection of the ComEd transmission system and the ATC transmission system and defines the continuing responsibilities and obligations of ComEd and ATC with respect to the upgrade to the interconnection of their systems.

As PJM explained, while the document files submitted with the 11/1/10 filing correctly showed all redlined changes to the Tariff and OA intended by that filing, four of the electronic Tariff and OA sections that were intended to be submitted with that filing were missing or incorrect. The proposed modifications have been reviewed on September 8, 2010 and endorsed on October 6, 2010 by the Planning Committee. On December 30, 2010, the Commission issued an Order in Docket Nos. ER10-1196-001, ER11-1987-000, ER11-1988-000, and ER11-1988-001, conditionally accepting PJM's filing of revised tariff sheets (PJM Open Access Transmission Tariff and PJM Amended and Restated Operating Agreement) designating PJM Settlement, Inc., a new public utility, as the counterparty to transactions in the PJM Interconnection markets, with an effective date of January 1, 2011. PJM is directed to make a compliance filing within thirty days of the date of this order.

On December 30, 2010, the Commission issued an Order in Docket No. ES11-8-000, authorizing the issuance of securities and approving guaranty. PJM sought Commission authorization for (1) PJM Settlement to guarantee obligations of PJM; (2) a line of credit provided by PJM to PJM Settlement; and (3) a line of credit provided by PJM Settlement to PJM. These arrangement are in connection with the formation of PJM Settlement as the counterparty to transactions in the PJM markets.

On December 21, 2010, the Commission issued a Letter Order, in Docket No. ER11-87-000, accepting a compliance filing wherein PJM made modifications to the Tariff and Amended and Restated Operating Agreement that was proposed on July 13, 2010, in Docket No. ER10-1762-000. PJM clarified its proposed language to require that a generator submit an economic minimum bid that is no greater than the higher of its physical operating minimum or its capacity interconnection rights. On October 14, 2010 PJM filed an errata filing to correct administrative and technical errors. The filing is effective September 17, 2010.

ER10-2637-000, et al., accepting a revised interconnection agreement among PJM, Calpine New Jersey Generation LLC, and Atlantic City Electric Company. PJM indicated that the parties agreed to revise the ISA (i) to capture the customer’s new name; (ii) further delineate the capacity interconnection rights that are attributable to the two generating units that comprise the interconnection request; (iii) and revise the current level of security that must be retained under the agreement. The agreement is effective August 30, 2010.

On December 13, 2010, the Commission issued a Letter Order, in Docket No. ER11-127-000, conditionally accepting for filing an executed ISA between PJM and Virginia Electric and Power Company. The ISA provides for the interconnection of the Lost River Wind Farm, a 130 MW facility located in Rockingham County, Virginia. PJM indicated, among other things, that the ISA contains non-standard terms and conditions and a Monthly Charge. The terms and conditions are non-standard in that the contract provides for a zero dollar Initial Security Amount. The ISA is effective September 16, 2010. The Commission directed PJM to submit certain sections of the filing; because, it did not display correctly in the eTariff. The filing is due within 30 days of the date of the issuance of this Order.

On December 13, 2010, the Commission issued a Letter Order, in Docket No. ER11-2078-000, accepting an executed Wholesale Market Participation Agreement (WMPA) with SX Landfill Energy, LLC and Jersey Central Power & Light Company. On November 10, 2010, PJM subsequently filed in the instant docket First Revised Service Agreement No. 2646 to correct a typographical error in Section 1 of the WMPA. The effective date of September 17, 2010 is accepted as requested. This establishes an eTariff title under which PJM will file future electronic submissions of its service agreements.

On November 8, 2010, the Commission issued a Letter Order, in Docket No. ER10-2704-000, accepting an executed interim Interconnection Service Agreement (ISA) entered into among PJM, Meadow Lake Wind Farm IV LLC, Meadow Lake Wind Farm V LLC, and Indiana Michigan Power Company. The ISA facilitates the interconnection of a 200 MW wind generating facility located near Chalmers, Indiana. PJM submitted the ISA for filing because it contains non-conforming language that is necessary to accommodate the interconnection request, i.e., non-standard terms and conditions relating to the ownership of the facility by two separate entities. The ISA is effective August 17, 2010.

On November 8, 2010, the Commission issued a Letter Order, ER10-3313-000, accepting three executed nonconforming agreements: (i) an Interconnection Service Agreement and an executed Interconnection Construction Service Agreement between PJM, AES New Creek, LLC (AES New Creek) and Virginia Electric and Power Company (Dominion Virginia) (“AES New Creek ISA” and AES New Creek/Dominion ICSA” respectively); and (ii) an Interconnection Construction Service Agreement between PJM, AES New Creek, and Potomac Edison Company (“AES New Creek/Allegheny ICSA”). The agreements (collectively “AES New Creek Agreements”) are filed under the PJM Service Agreements Tariff. The AES New Creek Agreements contain non-standard terms and conditions, specifically, what AES New Creek must do if it wants a commercial operation date for any of the units by December 31, 2011 rather than by May 31, 2012. The parties included language in the AES New Creek Agreements to accommodate these terms. Finally, the AES New Creek ISA contains a monthly charge, along with an associated explanation and support for the monthly charge. The AES Creek Agreements are effective September 1, 2010.
