On January 6, 2011, in Docket No. ER12-469-000, PJM Interconnection, L.L.C. filed an answer opposing a motion for summary disposition and responding to other pleadings regarding PJM's November 22, 2011, petition for an order establishing a proceeding to determine the proper billing adjustments to correct errors in PJM's payments to certain owners of generation units of Balancing Operating Reserve Lost Opportunity ("BOR LOC") credits for certain periods of 2009-2011, and, to the extent necessary to implement the Commission's determination, a waiver of certain provisions of PJM's Tariff and Operating Agreement. PJM urged the Commission to deny the motion for summary disposition, and otherwise to grant the relief requested in the previously filed petition.

On January 6, 2012, in Docket No. ER12-636-001, PJM submitted to FERC an Amendment to its December 19, 2011 filing to i) revise its proposed revision to Section 15 of Attachment DD of the PJM Tariff as it could be interpreted as a substantive change that was not intended to be made; and ii) propose revisions to Section 1.5.6(g) of Schedule 6 of the PJM Operating Agreement to change the words “transmission zones” and “zones” to the defined Tariff term “Zones” for purposes of consistency with the remainder of that section. Consistent with its December 19th Filing, PJM requested that the Commission issue its order by no later than February 17, 2012 with an effective date of February 18, 2012.

On January 6, 2012, in Docket No. ER12-773-000, PJM submitted amendments to Schedule 12-Appendix of the PJM Tariff to incorporate cost responsibility assignments for 167 baseline upgrades included in the recent update to the Regional Transmission Expansion Plan (“RTEP”) approved by the PJM Board of Managers (“PJM Board”) on December 7, 2011. The requested effective date is April 5, 2012.

On January 5, 2012, in Docket Nos. AD12-1 and ER11-4081, PJM filed a Letter from Michael J. Kormos to Chairman Wellinghoff and the Commissioners responding to issues raised by the Midwest ISO and the Michigan Public Service Commission concerning capacity portability and a joint and common market.

On January 5, 2012, in Docket No. ER11-3322-001, PJM filed revisions to the PJM Tariff, Operating Agreement, and Reliability Assurance Agreement and other information to comply with the Commission's order of November 4, 2011, accepting, subject to certain conditions, PJM's April 7, 2011, changes to the rules governing measurement and verification of capacity curtailment by providers of Load Management resources in PJM's capacity market. The compliance filing includes: an explanation of DR aggregation and how under-performance penalties will be applied under the newly approved rules; revisions to add the compliance requirements for Firm Service Level ("FSL") participants to Attachment DD-1 of the PJM Tariff and Schedule 6 of the RAA; revisions clarifying that DR resources will receive energy market payments for measured reductions in consumption during emergency events, even if load exceeds PLC; revisions providing descriptions of and other information regarding comparison load baselines; and a proposed transition provision to apply during RPM delivery years 2012-2013 through 2014-2015 that "protects the reasonable reliance expectations of DR suppliers" from potential adverse consequences of implementation of the new DR capacity performance metric approved by the Commission.

On January 3, 2012, in Docket No. EL12-8-000, PJM Interconnection, L.L.C. filed a limited answer to correct mis-statements of facts and confirm that it has identified five market participants that impermissibly reported purely financial internal bilateral transactions ("IBTs") to PJM.

On January 3, 2012, PJM submitted for filing an errata to amend the December 30, 2011 filing letter in Docket Nos. ER12-721-000 and ER12-722-000. The December 30, 2011 filing proposes revisions to Attachment L of the PJM Tariff and Attachment A of the TOA to include the City of Hamilton, Ohio as a PJM Transmission Owner. PJM requests the attached OATT section and TOA section have an effective date of February 29, 2012.

On December 30, 2011, PJM submitted to the Commission for filing an update to the informational filing dated May 12, 2011, in Docket No. ER08-47-005. PJM informs the Commission that the modifications to the current eMKT Opportunity Cost Calculator needed to change the calculation of opportunity costs will not be completed until approximately January 31, 2012.

On December 30, 2011, in Docket Nos. ER12-721-000 and ER12-722-000, PJM filed, on behalf of the City of Hamilton, Ohio, revisions to Attachment L of the PJM Open Access Transmission Tariff and Attachment A of the TOA to include the City of Hamilton, Ohio as a PJM Transmission Owner. On December 29, 2011, in Docket Nos. ER12-91-001 and ER12-92-001, Duke Energy Ohio, Inc. and Duke Energy Kentucky, Inc. (“Duke Companies) and PJM jointly filed an Amendment to the October 14, 2011 filing requesting revisions to the PJM Tariff and certain other documents in connection with the Duke Companies’ move from the Midwest Independent Transmission System Operator, Inc. Regional Transmission Organization to PJM. The amendment requests an extension of the December 31, 2011 deadline for FERC action in the related proceedings. The filing has no textual changes to the PJM Tariff, PJM Operating Agreement, PJM Reliability Agreement or PJM Consolidated Transmission Owners Agreement.

On December 23, 2011, in Docket No. ER12-681-000, PJM and Progress Energy Carolinas, Inc., filed with the Commission proposed revisions to their Joint Operating Agreement to allow the parties additional time to consider the development of a loss compensation process for non-firm power flows that cause parallel flows on the neighboring transmission system.

On December 19, 2011, PJM filed tariff revisions in Docket No. ER11-2875 to comply with FERC's November 17, 2011 order in that proceeding. Specifically, PJM revised the reliability pricing model's minimum offer price rule to (1) remove the requirement that case-specific MOPR exception requests must use the nominal levelized financial model; (2) apply the MOPR to a resource, even if it is an existing resource, until it clears an RPM auction; (3) clarify MOPR's application to capacity imports; and (4) apply the MOPR to RPM's incremental auctions immediately. PJM proposed that the compliance revisions take effect on the day of the filing, i.e., December 19, 2011.

On December 19, 2011, in Docket No. ER12-636-000, PJM submitted for filing, numerous non-substantive, clerical, ministerial and substantive revisions to correct, clarify and/or make consistent certain provisions of the PJM Open Access Transmission Tariff, Amended and Restated Operating Agreement of PJM Interconnection, L.L.C. and Reliability Assurance Agreement Among Load Serving Entities in the PJM Region. Further, PJM also requested a limited waiver as may be necessary to excuse PJM’s failure to fully comply with the provisions of Section 3.2.3A(e) and (f) of Schedule 1 of the Operating Agreement and the identical, parallel provisions of Attachment K-Appendix of the Tariff with respect to the calculation of the Synchronized Reserve Market Clearing Price and the credit due to a Generating Market Buyer providing Tier 2 Synch Reserves. PJM requested that the Commission issue its order accepting the enclosed revisions by no later than February 17, 2012, with an effective date of February 18, 2012.

On December 13, 2011, in Docket No. ER11-2815-004, American Transmission Systems, Incorporated (“ATSI”) filed an errata with the Commission to correct a technical error submitted in the June 30, 2011 Compliance Filing under Docket No. ER11-2815-002. The errata restores the location of Attachment H-21 and Attachment H-21A in the PJM Open Access Transmission Tariff. There are no textual or substantive changes made in this errata filing to the tariff sections.

On December 12, 2011, in Docket No. ER12-xxx-000, PJM submitted to the Commission, an informational report 20 days in advance of Duke Energy Ohio, Inc., and Duke Energy Kentucky, Inc. (together “DEOK”) integrating into PJM, as required under a FERC order issued on March 18, 2004, in the PJM MISO JOA proceeding (the “JOA” Order). In the JOA Order, the FERC said “for assurance that readiness is complete, the RTOs shall file with the Commission an informational report 20 days in advance of the integration of a new transmission system… This report shall explain any testing of data exchanges and communication systems, or other measures taken to assure that systems are ready to implement any newly effected provision of the JOA.” See, Midwest Independent Transmission System Operator, Inc. and PJM Interconnection, L.L.C. 106 FERC ¶ 61,251 (March 18, 2004) at P 104.
12.09.2011 Docket No. RM11-17-000 (PDF)
On December 9, 2011, in Docket No. RM11-17-000, PJM joined the ISO/RTO Council in submitting a Motion for an Extension of Time to File Comments to the Commission’s Notice of Proposed Rulemaking regarding the Enhancement of Electricity Market Surveillance and Analysis through Ongoing Electronic Delivery of Data from RTOs and ISOs for an additional 30 days, until January 26, 2012. Given the upcoming end-of-year and holiday season, the IRC requests that the Commission shorten to three business days the time for filing answers to this Motion.

On December 9, 2011, the Joint RTO Commentors submitted their Comments in Docket No. AD12-1-000. Specifically, the Joint RTO Commentors commented that no additional tools and processes are necessary, and that more processes may actually be detrimental to getting needed solutions into place in a timely fashion. Rather, more flexibility in the compliance deadline through a mechanism such as the Reliability Safety Valve the Joint RTOs have previously proposed to EPA, should be urged by the Commission. The Joint RTO Commentors also commented that any limitations on the operations of reliability critical units should be determined on a case-by-case basis, because each unit will have different operating characteristics, air emissions profiles, and impacts on dispatch should the unit be unavailable.

On December 9, 2011, in Docket No. AD12-1-000, PJM submits Post Technical Conference Comments in response to questions of Commissioner Moeller concerning the potential reliability impact of EPA rules. In its comments, PJM stresses the importance of a “safety valve” to provide needed flexibility from the compliance deadline for those units who provide early notification of their retirement decisions and, if such units are determined to be reliability critical units, will receive a “safe harbor” from EPA penalties. PJM pledges to work with the Commission, states in its region, and its stakeholders as the EPA rules become finalized.

On December 5, 2011, at Docket No. ER12-529-000, PJM filed with the Commission a revision to Section 15.1.6(c) (a) of the Operating Agreement proposing to remove the word “terminated” in relation to characterizing a member, who upon default, will have their forward positions liquidated in accordance with the Tariff and/or Operating Agreement.

On December 2, 2011, in Docket No. ER12-525-000, PJM Interconnection, L.L.C. submitted for filing revisions to the Markets Settlement Section of its Emergency Load Response Program set forth in to Schedule 1 of the Amended and Restated Operating Agreement of PJM Interconnection, L.L.C., and the parallel provisions of the Attachment K- Appendix of the PJM Open Access Transmission Tariff, concerning the allocation of demand response emergency energy costs and charges relating to deviations from the number of megawatts a resource cleared in the PJM Day-ahead Energy Market and the actual number of megawatts the resource provided in real-time. PJM proposed an effective date of February 1, 2012 for the revisions and requested that the Commission issue its order accepting the revisions by no later than January 31, 2012.
12.01.2011 Docket No. ER12-513-000 (PDF)
On December 1, 2011, PJM filed with FERC in Docket Number ER12-513-000, revisions to its Open Access Transmission Tariff under FPA section 205 as a result of a triennial review and performance assessment of the Reliability Pricing Model ("RPM"). As a result of the triennial review, PJM revised the Tariff's Cost of New Entry ("CONE"), the shape of the Variable Resource Requirement Curve, and the Energy and Ancillary Services Revenue offset methodology. As a result of the performance assessment, PJM eliminated a "hold-back" against the minimum requirements for two resource categories. PJM also made conforming changes to the CONE used to screen offers under the Minimum Offer Price rule, clarified the New Entry Price Adjustment, and set a date certain for PJM to file Tariff changes for a voluntary long-term auction. The Tariff changes have a proposed effective date of January 31, 2012.

01.05.2012 Docket No. ER12-490-000 (PDF)
On January 5, 2012, the Commission issued a Letter Order, in Docket No. ER12-490-000, accepting an executed WMPA among Public Service Electric and Gas Company (PSE&G) and PSE&G. PJM indicated that PSE&G intends to engage in wholesale sales in the PJM markets from a 0.60 MW solar facility connected to PSE&G distribution facilities located in Clifton, Passaic County, New Jersey. Also, the WMPA is a contractual means to address a generator interconnection request through the distribution system, both to enable PJM to properly track and study such an interconnection and to facilitate the generator’s participation in PJM’s wholesale markets. The WMPA is effective November 1, 2011.
01.03.2012 Docket No. ER12-474-000 (PDF)
On January 3, 2012, the Commission issued a Letter Order, in Docket No. ER12-474-000, accepting an executed Interim Upgrade Construction Service Agreement (Interim UCSA) among PJM, Exelon Generation Company, L.L.C (ExGen) and Commonwealth Edison Company (ComEd). PJM indicated that the Interim UCSA was filed because ExGen wishes to begin construction of certain customer-funded upgrades prior to executing a final Upgrade Construction Service Agreement as contained in Attachment GG of the PJM Tariff. The Interim UCSA is effective October 28, 2011.

On January 3, 2012, the Commission issued a Letter Order, in Docket No. ER12-535-000, accepting an executed Interim ISA and an executed ICSA among PJM, Virginia Electric and Power Company (Interconnection Customer), Virginia Electric and Power Company (Interconnected Transmission Owner). PJM indicated that both the Interim ISA and the ICSA facilitate the interconnection and construction of 1,551 MW located in Brunswick County, MD to the PJM transmission system. The agreements are effective November 4, 2011.

On January 3, 2012, the Commission issued a Letter Order, in Docket Nos. ER12-171-000, et al., accepting an executed PSE&G WMPA among PJM, Public Service Electric and Gas Company (Wholesale Market Participant) and Public Service Electric and Gas Company (Transmission Owner). PJM indicated that the PSE&G WMPA was submitted for filing because the Wholesale Market Participant intends to engage in wholesale sales in the PJM markets from a generating facility connected to the Transmission Owner distribution facilities. The PSE&G WMPA is effective September 22, 2011.

On January 3, 2012, the Commission issued a Letter Order, in Docket Nos. ER12-175-000, et al., accepting an executed Wholesale Market Participation Agreement (PSE&G WMPA) among PJM, Public Service Electric and Gas Company (Wholesale Market Participant) and Public Service Electric and Gas Company (Transmission Owner). PJM indicated that the PSE&G WMPA was submitted for filing because the Wholesale Market Participant intends to engage in wholesale sales in the PJM markets from a generating facility connected to the Transmission Owner distribution facilities. The PSE&G WMPA is effective September 22, 2011.
12.30.2011 Docket No. ER12-470-000 (PDF)
On December 30, 2011, the Commission issued a Letter Order, in Docket No. ER12-470-000, accepting a revised ISA (Fremont ISA) and interconnection construction service agreement (Fremont ICSA) among PJM, American Transmission Systems, Incorporated (ATSI), and American Municipal Power, Inc. (AMP) (collectively, the Fremont Agreements). PJM indicated that the parties had agreed to amend Original Service Agreement Nos. 2960 and 2972 that support the interconnection of the Fremont Energy Center, which was transferred from FirstEnergy Generation Corp. (FEG) to AMP on July 21, 2011. PJM further indicated, among other things, that AMP had requested, and the parties agreed, that the Original Service Agreements be amended as incorporated in the Fremont ISA and ICSA to include AMP as the current Interconnection Customer and that section 4.0 of the Fremont ISA and section 4.1 of the Fremont ICSA reflect that the effective date is July 21, 2011, the day FEG transferred Fremont Energy Center to AMP.

On December 29, 2011, the Commission issued a Letter Order, in Docket No. ER12-521-000, accepting an executed WMPA entered into among PJM, Topoint CL Gloucester LLC (Topoint CL Gloucester), and PSE&G. PJM submitted the WMPA for filing because Topoint CL Gloucester intends to engage in wholesale sales in the PJM markets from a generating facility connected to the PSE&G distribution facilities. On December 29, 2011, in Docket No. EL12-19-000, the Commission issued a Notice of Complaint advising that FirstEnergy Solutions Corp., and Allegheny Energy Supply Company, LLC, collectively filed a formal complaint against PJM alleging that provisions of the PJM Open Access Transmission Tariff and Operating Agreement, as related to the rules governing the funding of Financial Transmission Rights, are unjust, unreasonable, unduly discriminatory and preferential. The answer, motions to intervene, and protests to this complaint must be filed by January 13, 2012.

On December 28, 2011, in Docket No. ER11-3384-002, the Commission issued an Order accepting PJM’s proposed revisions to the definitions of Non-Regulatory Opportunity Cost and Energy Market Opportunity Cost, with an effective date of April 16, 2011, as requested.

On December 28, 2011, the Commission issued an order accepting the filing submitted on November 10, 2011, in Docket No. ER11-3979-003 et al, in accordance with the Commission’s June 16, 2011 Order Approving Contested Settlement and the Settlement between PJM and MISO in Docket Nos. EL10-45, EL10-46 and EL11-60. PJM submitted revisions to Section 6.6 of Attachment 2 Congestion Management Process to the JOA between PJM and MISO. Pursuant to the Settlement, PJM and MISO revise the methodology for determining the Firm Flow Entitlements in the M2M settlement calculation to provide for the use of point-to-point transmission service schedules instead of reservations. PJM and MISO request an effective date of December 1, 2011.

On December 28, 2011, the Commission issued a Letter Order, in Docket No. ER12-359-000, accepting two executed ISAs among PJM, Commonwealth Edison Company (ComEd). PJM submitted a notice of cancellation for Interim Interconnection Service Agreement No. 2545, which is being superseded by the Top Crop ISAs. PJM submitted the Top Crop ISAs for filing because they contain non-standard terms and conditions that are necessary to accommodate the unique circumstances of the interconnection, namely the ownership of the facility by two separate entities. PJM submitted the WMPA for filing because Pennoni intends to engage in wholesale sales in the PJM markets from a generating facility connected to the PSE&G distribution facilities. The WMPA is effective November 3, 2011.

On December 27, 2011, the Commission issued a Letter Order, in Docket No. ER12-494-000, accepting an executed WMPA entered into among PJM, RE Cranbury Solar I, LLC (RE Cranbury), and PSE&G. PJM submitted the WMPA for filing because the RE Cranbury intends to engage in wholesale sales in the PJM markets from a generating facility connected to the PSE&G distribution facilities. The WMPA is effective November 1, 2011.

On December 27, 2011, in Docket No. ER12-271-000, the Commission issued a Letter Order accepting PJM’s proposed revisions, with an effective date of December 30, 2011 as requested, to Section 11 of Attachment DD of the PJM Open Access Transmission Tariff to modify the Demand Resource and ILR Compliance Penalty Charge provisions of the Reliability Pricing Model so that Compliance charges for a Load Management event are assessed and billed in two phases.

On December 21, 2011, the Commission issued a Letter Order, in Docket No. ER12-449-000, accepting an executed WMPA among PJM, Broadway Springs, LLC (Broadway Springs) and JCP&L. PJM indicated, among other things, that Broadway Springs intends to engage in wholesale sales in the PJM markets from a 10.0 MW solar facility connected to JCP&L’s distribution facilities located in Broadway, New Jersey. On December 16, 2011, the Commission issued a Letter Order, in Docket No. ER12-392-000, accepting an executed nonconforming ISA among PJM, East Coast Power Linden Holding, L.L.C., and Public Service Electric & Gas Company (PSE&G). PJM indicated, among other things, that the ISA facilitates the interconnection to the PJM transmission system of a 180 MW combustion turbine generating unit located in Linden, New Jersey, and provides for capacity interconnection rights in the amount of 20 MW. The ISA is effective October 11, 2011.

On December 16, 2011, the Commission issued a Letter Order, in Docket No. ER12-400-000, accepting an executed WMPA among PJM, Rob Schanzlin and JCP&L. PJM indicated, among other things, that Mr. Schanzlin intends to engage in wholesale sales in the PJM markets from a 1.6 MW solar facility connected to JCP&L’s distribution facilities located in Washington, New Jersey. The WMPA is effective October 12, 2011.

On December 15, 2011, in Docket No. RM10-17-001, FERC issued an Order on Rehearing and Clarification, denying rehearing of Order No. 745 and granting in part and denying in part clarification regarding certain provisions of the order. Order No. 745 amended Commission regulations to require that a demand response resource participating in an organized wholesale energy market must be compensated for the service it provides at the market price for energy when the demand response resource has the capability to balance supply and demand as an alternative to a generation resource and when the dispatch of demand response resource is cost-effective.

On December 15, 2011, in Docket No. ER11-4106-000, the Federal Energy Regulatory Commission (“Commission”)issued an order accepting, subject to conditions, PJM’s July 22, 2011 proposed revisions to the PJM Tariff and the Amended and Restated Operating Agreement of PJM Interconnection, L.L.C., effective, as requested by PJM, on the first day of the calendar month that is at least 90 days after the date of the Commission’s order. The Commission also ordered PJM to make an additional compliance filing within 90 days of the date of the order. PJM’s proposed revisions addressed the requirements established by Order No. 745.

In response to proposed revisions filed by PJM on September 23, 2011, on December 14, 2011, the Commission issued an order in Docket No. ER11-4628-000 accepting and suspending proposed changes to the PJM Tariff, OA, and RAA, for a five month period to become effective May 15, 2012, subject to refund, and to the outcome of a technical conference and a further order. The purpose of the proposed changes was to recognize and support, at the wholesale level, the development of price responsive demand (“PRD”)—demand reductions enabled by advanced meters and dynamic retail rate structures—by states in the PJM region. The order directed Commission Staff to convene a technical conference within 60 days following the date of the order.

On December 13, 2011, in Docket No. RM11-17-000, the Commission issued a Notice of Extension of Time to file comments in response to the Commission’s Notice of Proposed Rulemaking regarding the Enhancement of Electricity Market Surveillance and Analysis through Ongoing Electronic Delivery of Data from RTOs and ISOs, extending the period for filing comments in this proceeding to and including January 26, 2012.

On December 7, 2011, in FERC Docket No. ER12-167-000, the Commission issued a Letter Order accepting PJM's filing of Network Integration Transmission Service Agreements (“NITSAs”) to convert existing Network Integration Transmission Service (“NITS”) and point-to-point transmission service currently provided under the MISO tariff for service in the Duke Energy Ohio, Inc. and Duke Energy Kentucky, Inc. transmission service areas (the “DEOK Zone”) to NITS under the PJM Tariff to accomplish the integration of the DEOK Zone into PJM. The effective date for the NITSAs is January 1, 2012.

On December 7, 2011, the Commission issued a Letter Order, in Docket No. ER12-61-000, accepting two executed ISAs among PJM, Monongahela Power Company, and the two separate owners of the Beech Ridge Wind Farm – Beech Ridge Energy LLC
and Beech Ridge Energy II LLC (Beech Ridge ISAs). PJM also submitted a notice of cancellation of the Original Beech Ridge ISA, which is being superseded by the Beech Ridge ISAs. PJM indicated that the Beech Ridge ISAs contained non-standard terms and
conditions that are necessary to accommodate and coordinate the separate ownership interests in the Beech Ridge Wind Farm. The ISAs are effective September 8, 2011.

On December 6, 2011, the Commission issued a Letter Order, in Docket No. ER12-358-000, accepting an executed ISA entered into among PJM, Preble Solar Energy LLC (Preble Solar), and The Dayton Power and Light Company (Dayton). PJM indicated that the ISA facilitates the interconnection to the PJM transmission system of a 2.0 MW solar generating facility located in Somers, Ohio and contains terms that do not conform to the form of the ISA set forth in Attachment O to the PJM Tariff. The ISA is effective October 6, 2011.

PJM submitted the WMPA for filing because the Marina Energy intends to engage in wholesale sales in the PJM markets from a generating facility connected to the ACE distribution facilities. On December 6, 2011, in Docket No. ER12-412-000, the Commission issued an Order Granting Request for Limited Tariff Waiver which grants PJM’s request for temporary, limited waiver of sections 14B.1, 14B.2, 15.1, 15.2, and 15.6 of its Operating Agreement and sections 7.1, 7.1A, 7.3, and 10.4 of the PJM OATT to effectuate the requested waiver and to permit PJM to temporarily suspend rebilling and associated payment obligations for the time period October 2009 to October 2011 (August 2009 through October 2011 for Dominion), subject to the outcome of a separate filing submitted by PJM in Docket No. ER12-469-000. The Commission also granted Exelon’s request to broaden the scope of the requested waiver to operate as a blanket billing deferral applicable to all adjustments that will be made with respect to each of the 57 generators subject to PJM’s billing adjustments.

On December 2, 2011, in Docket No. ER12-125-000, the Commission issued a Letter Order accepting the October 19, 2011 revisions submitted by PJM to the PJM Emergency Load Response Program, found in Schedule 1 of the PJM Operating Agreement, as well as in the parallel provisions of Attachment K-Appendix of the PJM Transmission Tariff, effective December 19, 2011. These revisions clarify that completed PJM Emergency Load Response Registration Forms must be submitted to PJM no later than one day before the tenth business day preceding the relevant Delivery Year, and must be approved on or before May 31st preceding the relevant Delivery Year.
