The Federal Energy Regulatory Commission (FERC) is an independent agency that regulates the interstate transmission of electricity, natural gas and oil. All publicly available documents filed by PJM or its transmission owners with the FERC this year are posted here in chronological order. On January 31, 2012, in Docket No. ER12-525-001, PJM re-submitted revisions to the Markets Settlement Section of its Emergency Load Response Program concerning the allocation of demand response emergency energy costs and charges, as an errata filing to correct an administrative and technical error in the meta-data code used when PJM originally submitted the same revisions to the Commission on December 2, 2011, which revisions the Commission has already accepted in a letter order issued on January 20, 2012. No textual or substantive changes are being made in this errata filing.

On January 30, 2012, in Docket No. ER11-3322-001, PJM filed an answer to protests and comments relating to PJM's filing of January 5, 2012, to comply with the Commission's order of November 4, 2011, regarding changes to PJM's rules governing measurement and verification of capacity performance by providers of Load Management resources. PJM's answer urged the Commission to deny the protests; to reject alternative transition mechanisms for RPM delivery years 2012-2013 through 2014-2015 to protect "the reasonable reliance expectations of DR suppliers" that previously cleared capacity commitments for the transition years in the PJM capacity market; and to accept PJM's compliance filing without condition or modification.

On January 30, 2012, in Docket No. EL12-19-000, PJM, Interconnection, L.L.C. submitted a motion for leave to answer and an answer to certain interventions, comments, protests and answers to the complaint and request for fast track processing of FirstEnergy Solutions Corp. and Allegheny Energy Supply Company, LLC (collectively “FirstEnergy Companies”) filed on December 28, 2011 (“Complaint”). FirstEnergy Companies seek to modify certain provisions found in Schedule 1 of the PJM Operating Agreement, as well as the parallel provisions of the Attachment K – Appendix of the PJM Tariff, that govern the funding of Financial Transmission Rights.

On January 27, 2012, PJM resubmitted in Docket No. ER11-2875-003 compliance tariff revisions previously submitted in that proceeding on December 19, 2011 in order to address the consequences of an eTariff coding issue in an unrelated filing that revised the same Tariff section. The enclosed revised Tariff section still has a requested effective date of December 19, 2011.

On January 27, 2012, in Docket No. ER12-296-002, Public Service Electric and Gas Company (“PSE&G”) submits with the Commission revisions to the PJM Open Access Transmission Tariff (“OATT”) Attachment H-10A, specifically revising Attachment 7, of Attachment H-10A to reflect the ROE incentive granted in PJM Interconnection, L.L.C. and Public Service Electric and Gas Company, 137 FERC ¶ 61,253 (2011) (the “December 30 Order”) for the Northeast Grid Reliability Project (“NGR Project”). In the December 30 Order, the Commission granted in part and denied in part revised tariff provisions submitted by PJM on behalf of PSE&G to PJM’s OATT which would implement incentive rate treatment.

On January 27, 2012, in Docket No. ER12-910-000, PJM submitted on behalf of Duke Energy Business Services, LLC (“DEBS”), which is acting as agent for Duke Energy Ohio, Inc. (“DEO”), a service agreement for filing in the PJM Service Agreements Tariff database. The Service Agreement (No. 3193) is a generator interconnection agreement (“Madison GIA”) between DEBS and Duke Energy Indiana, Inc. (“DEI”) in its role as owner of the Madison Generating Station.

On January 25, 2012, in Docket No. RM11-17-000, PJM joined the ISO/RTO Council in submitting Comments of the ISO/RTO Council to the Commission’s Notice of Proposed Rulemaking regarding the Enhancement of Electricity Market Surveillance and Analysis through Ongoing Electronic Delivery of Data from Regional Transmission Organizations and Independent System Operators.

On January 23, 2012, in Docket No. ER12-863-000, PJM Interconnection, L.L.C., submitted for filing, amendments to Schedule 12 of the OA and Schedule 17 of the RAA to update those lists to include new members, delete withdrawing members and reflect updates to signatories and reflect corporate name changes. An effective date of December 31, 2011 has been requested.

On January 17, 2012, in Docket No. ER12-816-000, American Electric Power Service Corporation (“AEPSC”) on behalf of its affiliates Ohio Power Company and AEP Ohio Transmission Company, (referred to as “AEP”) filed a 30th revision to the AEPSC & Buckeye ILDSA under Service Agreement No. 1336, requesting an effective date of January 18, 2012.

On January 13, 2012, in Docket No ER12-721-001, PJM filed an Errata with the Commission to correct an administrative error in the filing submitted on December 30, 2011. This Errata Filing does not change the substance of the Hamilton Filing nor does PJM change the proposed OATT and TOA revisions. PJM corrects the TOA tariff record to add the TOA Attachment A and the TOA signature page for Hamilton.

On January 13, 2012, PJM filed an answer in Docket No. ER12-513-000, to various comments and protests on PJM's 12/1/2011 to revise certain RPM tariff provisions. The tariff changes result from the 2011 triennial review of RPM's key auction parameters, and the 2011 performance assessment of RPM. PJM's answer rebutted criticisms of the December 1 Filing's changes to the gross CONE values, the use of the median Net CONE to set the overall PJM Region Net CONE, elimination of 2.5% hold-backs against the minimum annual and extended summer resource requirements, changes to the VRR Curve shape, retention of the nominal levelized modeling approach and Handy Whitman index adjustment and several other issues. PJM repeated its request that FERC approve the tariff changes by, and as of, 1/31/2012, to allow posting of correct auction parameters for the May 2011 BRA by 2/1/2012.

On January 6, 2011, in Docket No. ER12-469-000, PJM Interconnection, L.L.C. filed an answer opposing a motion for summary disposition and responding to other pleadings regarding PJM's November 22, 2011, petition for an order establishing a proceeding to determine the proper billing adjustments to correct errors in PJM's payments to certain owners of generation units of Balancing Operating Reserve Lost Opportunity ("BOR LOC") credits for certain periods of 2009-2011, and, to the extent necessary to implement the Commission's determination, a waiver of certain provisions of PJM's Tariff and Operating Agreement. PJM urged the Commission to deny the motion for summary disposition, and otherwise to grant the relief requested in the previously filed petition.

On January 6, 2012, in Docket No. ER12-636-001, PJM submitted to FERC an Amendment to its December 19, 2011 filing to i) revise its proposed revision to Section 15 of Attachment DD of the PJM Tariff as it could be interpreted as a substantive change that was not intended to be made; and ii) propose revisions to Section 1.5.6(g) of Schedule 6 of the PJM Operating Agreement to change the words “transmission zones” and “zones” to the defined Tariff term “Zones” for purposes of consistency with the remainder of that section. Consistent with its December 19th Filing, PJM requested that the Commission issue its order by no later than February 17, 2012 with an effective date of February 18, 2012.

On January 6, 2012, in Docket No. ER12-773-000, PJM submitted amendments to Schedule 12-Appendix of the PJM Tariff to incorporate cost responsibility assignments for 167 baseline upgrades included in the recent update to the Regional Transmission Expansion Plan (“RTEP”) approved by the PJM Board of Managers (“PJM Board”) on December 7, 2011. The requested effective date is April 5, 2012.

On January 5, 2012, in Docket Nos. AD12-1 and ER11-4081, PJM filed a Letter from Michael J. Kormos to Chairman Wellinghoff and the Commissioners responding to issues raised by the Midwest ISO and the Michigan Public Service Commission concerning capacity portability and a joint and common market.

On January 5, 2012, in Docket No. ER11-3322-001, PJM filed revisions to the PJM Tariff, Operating Agreement, and Reliability Assurance Agreement and other information to comply with the Commission's order of November 4, 2011, accepting, subject to certain conditions, PJM's April 7, 2011, changes to the rules governing measurement and verification of capacity curtailment by providers of Load Management resources in PJM's capacity market. The compliance filing includes: an explanation of DR aggregation and how under-performance penalties will be applied under the newly approved rules; revisions to add the compliance requirements for Firm Service Level ("FSL") participants to Attachment DD-1 of the PJM Tariff and Schedule 6 of the RAA; revisions clarifying that DR resources will receive energy market payments for measured reductions in consumption during emergency events, even if load exceeds PLC; revisions providing descriptions of and other information regarding comparison load baselines; and a proposed transition provision to apply during RPM delivery years 2012-2013 through 2014-2015 that "protects the reasonable reliance expectations of DR suppliers" from potential adverse consequences of implementation of the new DR capacity performance metric approved by the Commission.

On January 3, 2012, PJM submitted for filing an errata to amend the December 30, 2011 filing letter in Docket Nos. ER12-721-000 and ER12-722-000. The December 30, 2011 filing proposes revisions to Attachment L of the PJM Tariff and Attachment A of the TOA to include the City of Hamilton, Ohio as a PJM Transmission Owner. PJM requests the attached OATT section and TOA section have an effective date of February 29, 2012.
