On December 8, 2011, in Presidential Permit Docket No. PP-230-4 (Michigan/Ontario PARS), PJM submitted to the Office of Electricity Delivery and Energy Reliability, Department of Energy a letter requesting that the Department consider a meeting for all parties so that any questions or issues that the Department might have with the proposed settlement may be discussed with the parties prior to Department action. PJM's letter also calls the Department's attention to paragraph 9 of the settlement agreement, which states if the DOE makes changes to the Settlement Agreement that are not acceptable to any signatory, then DOE shall reopen the comment period for an additional 21 days and shall thereafter rule. PJM requests that its letter be docketed in DOE's Proceeding Number PP-230-4.

On October 14, PJM submitted to EPA on behalf of the PJM, ERCOT, Midwest ISO, NYISO, and SPP (“Joint RTO Commentors”) the “reliability safety valve” proposal for EPA’s consideration in its rulemaking proceeding (EPA-HQ-OAR-2009-0234) concerning National Emission Standards for Hazardous Air Pollutant from Coal- and Oil-Fired Electric Utility Steam Generating Units and Standards of Performance for Fossil-Fuel-Fired Electric Utility, Industrial-Commercial-Institutional, and Small Industrial-Commercial-Institutional Steam Generating Units. The proposal builds on the Joint RTO Commentors August 4 comments submitted to EPA in the same proceeding.

On August 4, 2011, Joint RTO Commentors, including ERCOT, MISO, NYISO, PJM, and SPP, submitted comments to the U.S. Environmental Protection Agency in Docket Nos. EPA-HQ-OAR-2009-0234; EPA-HQ-OAR-2011-0044, FRL-9286-1 concerning National Emission Standards for Hazardous Air Pollutant from Coal- and Oil-Fired Electric Utility Steam Generating Units and Standards of Performance for Fossil-Fuel-Fired Electric Utility, Industrial-Commercial-Institutional, and Small Industrial-Commercial-Institutional Steam Generating Units. In its comments, the Joint RTO Commentors ask EPA to incorporate a “reliability safety valve” in the Final Rule with respect to the compliance deadline to grant a unit-specific extension for complying with the Final Rule when: a generation owner provides at least 2 year’s notice of deactivation prior to the compliance deadline; the unit is considered to be a “Reliability Critical Unit;” and the transmission and/or resource reinforcements needed to mitigation any reliability impacts will take longer than the proposed compliance timeframe.

Notification to PJM Members of Disclosure of Confidential Information Pursuant to Operating Agreement Section 18.17.2(a) Dated: August 26, 2010 On May 11, 2011, PJM Interconnection, L.L.C. notifies the PJM Members that it is directed to disclose to the Department of Justice certain market sensitive information that is otherwise required to be maintained in confidence pursuant to the Operating Agreement. This obligation arises as a result of the Civil Investigation Demand (CID) received in connection with the U.S. Department of Justice's review of the proposed merger of Exelon Corp. and Constellation Energy.
