Under the PJM Tariff and Consolidated Transmission Owners Agreement these filings encompass the Transmission Owners' (TOs) exclusive rights to file for any changes in or recovery of the TO's transmission revenue requirements and any provisions of the PJM Tariff governing the recovery of transmission-related costs incurred by the TOs. On December 9, 2011, the Joint RTO Commentors submitted their Comments in Docket No. AD12-1-000. Specifically, the Joint RTO Commentors commented that no additional tools and processes are necessary, and that more processes may actually be detrimental to getting needed solutions into place in a timely fashion. Rather, more flexibility in the compliance deadline through a mechanism such as the Reliability Safety Valve the Joint RTOs have previously proposed to EPA, should be urged by the Commission. The Joint RTO Commentors also commented that any limitations on the operations of reliability critical units should be determined on a case-by-case basis, because each unit will have different operating characteristics, air emissions profiles, and impacts on dispatch should the unit be unavailable.

On October 31, 2011, in Docket No. ER12-296-000, Public Service Electric and Gas Company (“PSE&G”) submits requests for transmission rate incentives in accordance with Section 219 of the FPA and Order No. 679. The request seeks certain incentive rate treatment for PSE&G’s major baseline transmission project called the Northeast Grid Reliability Project (“NGR Project”). Specifically, PSE&G requests: (1) recovery of one hundred percent of Construction Work in Progress (“CWIP”) in rate base; (2) authorization to recover 100% of all prudently-incurred development and construction costs if the NGR Project is abandoned or cancelled, in whole or in part, for reasons beyond the control of PSE&G; and (3) a 100 basis point incentive adder to its return on equity (“ROE”). In addition, although PSE&G has not made any decision to do so, PSE&G also requests authority to assign these incentives to an affiliate, if construction and/or ownership of the NGR Project are assigned to such affiliate. This package of transmission rate incentives is tailored to the specific risks and challenges that PSE&G faces in financing and constructing the NGR Project.

On February 20, 2009, Baltimore Gas and Electric Company (“BGE”) filed a Federal Power Act Section 205 application at the Federal Energy Regulatory Commission (“FERC”) for incentives on its investment in certain new transmission. Specifically, BGE is requesting a 150 basis point adder to its base ROE of 11.3% for a $65 million 500 kV backbone transmission line to be constructed as part of the integrated multi-state, four transmission owner construction, baseline RTEP Mid-Atlantic Power Pathway (“MAPP”) Project. BGE also requests pre-approval of recovery of abandonment costs if the Project is cancelled for reasons beyond BGE’s control. Incentives have been approved for the portions of the MAPP Project owned by Pepco Holdings, Inc. and Dominion Virginia Power, and are also requested in a pending FERC application filed by Public Service Electric and Gas Company for its portion of the MAPP Project.

On April 24, 2008, in Docket No. ER08-868-000, ComEd filed with the Commission revisions to Attachment H-13 of the PJM OATT to: 1) revise wholesale distribution charges and distribution loss factors assessed to IMEA on behalf of Rock Falls and Winnetka; and 2) clarify language in Attachment H-13 concerning the calculation of the transmission losses. In compliance with the letter order issued on September 5, 2007, in Docket No. ER07-1134-000, Old Dominion has notified the Commission of its January 2, 2008 acquisition of certain transmission facilities owned by Delmarva Power & Light Company and located in the Virginia part of the Delmarva Peninsula. Accordingly, Old Dominion’s revisions to the PJM Tariff Sheets, Attachments H-3F and H-3G are accepted as of the September letter order date, to go into effect January 2, 2008.
