The Federal Energy Regulatory Commission (FERC) is an independent agency that regulates the interstate transmission of electricity, natural gas and oil. All publicly available FERC orders and notices related to PJM from this year are posted here in chronological order. On February 8, 2012, the Commission issued a Letter Order, in Docket No. ER12-707-000, accepting an executed ISA entered into among PJM, Day Four Solar LLC, and Jersey Central Power & Light Company, a First Energy Company. PJM indicated that the ISA facilitates the interconnection to the PJM transmission system of a 6.0 MW solar generating facility located in Wrightstown, New Jersey. PJM also explained that the ISA is being submitted for filing because it contains terms that do not conform to the form of the ISA set forth in Attachment O to the PJM Tariff. The ISA is effective November 28, 2011.

On February 8, 2012, the Commission issued a Letter Order, in Docket No.ER12-703-000, accepting an executed ICSA entered into among PJM, South Boston Energy, LLC, and Virginia Electric and Power Company. PJM indicated that the ICSA facilitates the interconnection of the 47.4 MW South Boston Energy Facility located in Halifax County, VA to the PJM transmission system. PJM also explained that the ICSA was submitted for filing because it supported the South Boston Interim Interconnection Service Agreement; therefore, this usage does not fully conform to the ICSA as set forth in Attachment P of the Tariff. The ICSA is effective November 28, 2011.

On February 8, 2012, the Commission issued a Letter Order, in Docket No. ER12-802-000, accepting an ISA among PJM, Harmony Solar LLC and Jersey Central Power & Light Company. PJM indicated, among other things, that the ISA facilitates the interconnection to the PJM transmission system of a 3.0 MW solar generating facility located in Philipsburg, New Jersey. The ISA is effective December 13, 2011.

On February 7, 2012, in Docket No. ER12-513-000, Chief Administrative Law Judge Curtis L. Wagner, Jr. issued an Order appointing the Honorable John P. Dring as the Settlement Judge. A settlement conference with Judge Dring is scheduled to convene at 10:00 a.m. on February 15, 2012, at FERC to explore the possibility of settlement, discuss the differences between the parties, and in general conduct the settlement negotiations.

On February 7, 2012, the Commission issued a Letter Order, in Docket No. ER12-723-000, accepting twelve service agreements. The service agreements were filed to address Duke Energy Ohio, Inc. and Duke Energy Kentucky, Inc. exit from the Midwest Independent Transmission System Operator, Inc. and integration into PJM on January 1, 2012. The service agreements are effective January 1, 2012.

On February 7, 2012, the Commission issued a Letter Order, in Docket No. ER12-745-000, accepting revisions to Schedule 12-Appendix of the PJM Tariff. The proposed revisions update the annual cost allocations for Regional Facilities and Necessary Lower Voltage Facilities included in the PJM Regional Transmission Expansion Plan to reflect changes in peak loads for the 12 months ending October 31, 2011, and to reflect changes required by the Commission’s Opinion No. 503 regarding the allocation of these costs to Merchant Transmission Providers. The revisions are effective January 1, 2012, subject to further proceedings to address issues raised on remand of the Commission’s Opinion No. 494 and Opinion No. 494-A.

On February 3, 2012, the Commission issued a Letter Order, in Docket No. ER12-640-000, accepting a Notice of Cancellation of an Interconnection Service Agreement (Lancaster ISA) among PJM, Lancaster Wind Farm, LLC (Lancaster) and Commonwealth Edison Company. PJM notified Lancaster in a letter, dated June 7, 2011, that it was in breach of the Lancaster ISA pursuant to section 6.1 of the ISA for failing to initiate construction of its facilities on or before April 15, 2011, and advised Lancaster that failure to cure the breach within 30 days would result in termination of the Lancaster ISA. PJM notified Lancaster, in a letter dated September 6, 2011, that it was in default of the Lancaster ISA and that the Lancaster ISA would be terminated effective September 14, 2011. The Notice of Cancellation is effective September 14, 2011.

On February 2, 2012, the Commission issued a Letter Order, in Docket No. ER12-706-000, accepting an executed Interim Upgrade Construction Service Agreement (Interim UCSA) among PJM, Exelon Generation Company, LLC (new service customer) and Commonwealth Edison Company (transmission owner). PJM indicated that the Interim UCSA is necessary so that the transmission owner can begin design, procurement and construction of the new service customer funded upgrades for the 345 kV line 15502 in advance of executing a final Upgrade Construction Service Agreement. The Interim UCSA is effective November 28, 2011.

On January 27, 2012, in Docket No. ER12-622-000, the Commission issued an Order accepting PJM Original Service Agreement No. 3151 - Mutual Operating Agreement between Virginia Electric and Power Company (Dominion) and Town of Windsor, North Carolina (Windsor). The Service Agreement is accepted for filing, effective January 1, 2012, subject to a revision to be filed within 30 days of the date of the order to correct the eTariff metadata error in which “PJM SA No. 3150” has been extraneously added to the section title.

On January 30, 2012, in Docket No. ER12-513-000, the Commission issued an Order accepting most of the RPM triennial review and performance assessment tariff changes submitted by PJM, effective January 31, 2012; suspending certain tariff changes related to cost of new entry (“CONE”) estimates for combustion turbine and combined cycle power plants for five months, to become effective June 30, 2012; and rejecting tariff changes concerning use of the median Net CONE from five CONE areas as the Net CONE for the PJM region. The Commission ordered PJM to file, within 30 days of its order, two compliance filings with revised tariff records reflecting removal of the proposed gross CONE values and the median Net CONE approach for the RTO region; and putting the suspended gross CONE values into effect.

On January 27, 2012, in Docket No. ER12-681-000, the Commission issued an Order accepting revisions filed by PJM and Carolina Power & Light Company to their Joint Operating Agreement to: (1) allow more time to develop a method to address situations where non-firm power flow on one system causes parallel flow on the adjacent system; (2) make ministerial revision to remove an inadvertent inclusion of drafting commentary; and (3) remove a redundant requirement to develop a list of generation and transmission facilities that may have an impact on the adjacent system. These revisions were accepted for filing, effective January 1, 2012, as requested.

On January 26, 2012, the Commission issued a Letter Order, in Docket No. ER12-533-000, accepting an executed ICSA among PJM, Iberdrola Renewables, Inc. (Iberdrola), and Virginia Electric and Power Company. PJM indicated, among other things, that the ICSA is being utilized with a conforming Interim ISA that facilitates the interconnection of Iberdrola’s Desert Wind Farm in North Carolina to the transmission system. The ICSA is effective November 4, 2011.

On January 25, 2012, the Commission issued a Letter Order, in Docket No. ER12-731-000, accepting a Notice of Cancellation of the executed WMPA entered into among PJM, Earl F. Stahl Jr. and Public Service Electric and Gas Company. The Notice of Cancellation is effective December 8, 2011.

On January 24, 2012, the Commission issued a Letter Order, in Docket No. ER12-697-000, accepting an executed WMPA entered into among PJM, Chesapeake Renewable Energy, LLC (Chesapeake Renewable) and Delmarva Power and Light Company (DPL). PJM submitted the WMPA for filing because Chesapeake Renewable intends to engage in wholesale sales in the PJM markets from a generating facility connected to the DPL distribution facilities. The WMPA is effective December 1, 2011.

On January 24, 2012, the Commission issued a Letter Order, in Docket No. ER12-698-000, accepting an executed WMPA among PJM, Garden Solar, LLC (Garden Solar) and Jersey Central Power and Light Company, A FirstEnergy Company (JCP&L). PJM submitted the WMPA for filing because Garden Solar intends to engage in wholesale sales in the PJM markets from a generating facility connected to the JCP&L distribution facilities. The WMPA is effective December 1, 2011.

On January 20, 2012, in Docket No. ER12-529-000, the Commission approved PJM's proposed ministerial revision to Section 15.1.6 c (a) of the Operating Agreement to remove the word "terminated" in relation to characterizing a Member who, upon an event of default, will have their forward positions liquidated in accordance with the Tariff and Operating Agreement, with an effective date of February 6, 2012, as requested.

On January 20, 2012, in Docket No. ER12-525-000, FERC issued a Letter Order accepting PJM’s December 2, 2011 submittal of revisions to the Markets Settlement Section of its Emergency Load Response Program provisions set forth in Attachment K-Appendix of the Tariff and Schedule 1 of the Operating Agreement concerning the allocation of demand response emergency costs and charges relating to deviations from the number of megawatts a resource cleared in the PJM Day-ahead Energy Market and the actual number of megawatts the resource provided in real-time, effective February 1, 2012 as requested.

On January 19, 2012, in Docket Nos. ER11-12-001 and ER11-3445-000, FERC issued an Order granting DC Energy Mid-Atlantic, LLC’s Request for Rehearing and rejecting PJM’s April 27, 2011 Compliance Filing submitted in response to the Commission's Order issued on March 30, 2011 regarding PJM's proposed revisions to the calculation of marginal losses. The Commission determined that it is not just and reasonable to limit the calculation of marginal line losses to only Reliability Monitored Facilities. PJM will file revised tariff records to remove the revisions relating to calculating marginal losses only for Reliability Monitored Facilities, but which retain the proposed revisions relating to generator step-up transformers, within 30 days of the date of the order.

On January 19, 2011, the Commission issued a Letter Order, in Docket No. ER12-448-000, accepting an executed Interim Upgrade Construction Service Agreement (Interim UCSA) among PJM, Exelon Generation Company, LLC (Exelon LLC) and Commonwealth Edison Company (ComEd). PJM indicated that the Interim UCSA is necessary to begin construction of the customer funded upgrades in advance of executing a final Upgrade Construction Service Agreement. The Interim UCSA is effective October 20, 2011.

On January 13, 2012, the Commission issued a Letter Order, in Docket No. ER12-531-000, accepting an executed non-conforming interim Interconnection Service Agreement (Chesterfield Interim ISA) and an Interconnection Construction Service Agreement (Chesterfield ICSA) among PJM, Virginia Electric and Power Company (VEPCO), and VEPCO. PJM submitted the Chesterfield Interim ISA for filing because it contains non-standard terms and conditions related to waiver of security in Interim ISA § 4(a). PJM requested, among other things, that the Commission permit VEPCO to set the Initial Security Amount required under § 4(a) of the Specifications for the Chesterfield Interim ISA at zero (0) dollars, since the interconnection customer and interconnected transmission owner are the same legal entity. The agreements facilitate the interconnection of the 1575 MW Chesterfield Combined Cycle Power Station located in Chesterfield County, Virginia to the PJM transmission system. The agreements are effective November 4, 2011.

On January 12, 2012, the Commission issued a Letter Order, in Docket No. ER12-616-000, accepting an executed WMPA entered into among PJM, Constellation Solar Federal, LLC (Constellation) and PSE&G. PJM also submitted a WMPA entered into among Earl F. Stahl Jr. (Wholesale Market Participant) and PSE&G. PJM submitted two separate WMPAs because the Wholesale Market Participant, Earl Stahl had assigned a portion of its project to a new Wholesale Market Participant, Constellation. The agreements are effective November 18, 2011.

On January 5, 2012, the Commission issued a Letter Order, in Docket No. ER12-490-000, accepting an executed WMPA among Public Service Electric and Gas Company (PSE&G) and PSE&G. PJM indicated that PSE&G intends to engage in wholesale sales in the PJM markets from a 0.60 MW solar facility connected to PSE&G distribution facilities located in Clifton, Passaic County, New Jersey. Also, the WMPA is a contractual means to address a generator interconnection request through the distribution system, both to enable PJM to properly track and study such an interconnection and to facilitate the generator’s participation in PJM’s wholesale markets. The WMPA is effective November 1, 2011.

On January 3, 2012, the Commission issued a Letter Order, in Docket No. ER12-474-000, accepting an executed Interim Upgrade Construction Service Agreement (Interim UCSA) among PJM, Exelon Generation Company, L.L.C (ExGen) and Commonwealth Edison Company (ComEd). PJM indicated that the Interim UCSA was filed because ExGen wishes to begin construction of certain customer-funded upgrades prior to executing a final Upgrade Construction Service Agreement as contained in Attachment GG of the PJM Tariff. The Interim UCSA is effective October 28, 2011.

On January 3, 2012, the Commission issued a Letter Order, in Docket No. ER12-535-000, accepting an executed Interim ISA and an executed ICSA among PJM, Virginia Electric and Power Company (Interconnection Customer), Virginia Electric and Power Company (Interconnected Transmission Owner). PJM indicated that both the Interim ISA and the ICSA facilitate the interconnection and construction of 1,551 MW located in Brunswick County, MD to the PJM transmission system. The agreements are effective November 4, 2011.

PJM indicated that the PSE&G WMPA was submitted for filing because the Wholesale Market Participant intends to engage in wholesale sales in the PJM markets from a generating facility connected to the Transmission Owner distribution facilities. The PSE&G WMPA is effective September 22, 2011.

PJM indicated that the PSE&G WMPA was submitted for filing because the Wholesale Market Participant intends to engage in wholesale sales in the PJM markets from a generating facility connected to the Transmission Owner distribution facilities. The PSE&G WMPA is effective September 22, 2011.

On December 15, 2011, in Docket No. RM10-17-001, FERC issued an Order on Rehearing and Clarification, denying rehearing of Order No. 745 and granting in part and denying in part clarification regarding certain provisions of the order. Order No. 745 amended Commission regulations to require that a demand response resource participating in an organized wholesale energy market must be compensated for the service it provides at the market price for energy when the demand response resource has the capability to balance supply and demand as an alternative to a generation resource and when the dispatch of demand response resource is cost-effective.
