Amendments Pending at FERC

The following governing agreement amendment filings were submitted to FERC and are not yet approved by FERC and are version of the conformed governing agreement posted on PJM’s website. The pending language can be found in the filing submitted to FERC and will be added to the conformed tariff once it has been approved and becomes effective.

12.21.2021 | at FERC | by PJM
On December 21, 2021, in Docket No. ER22-703-000, PJM submitted revisions to PJM Tariff, Attachment Q to revise the calculation of the Financial Transmission Right (FTR) Credit Requirement, which sets the Collateral that FTR Participants are required to provide in order to participate in PJM’s FTR market.
Effective: PJM requested an effective date of April 1, 2022, for the Tariff changes. PJM also requested that the Commission enter an order on or before February 26, 2022, and to extend the deadline for comments on this filing to 28 days.



12.21.2021 | at FERC | by PJM
On December 21, 2021, in Docket No. ER22-702-000, PJM submitted for filing revisions to the PJM Tariff, Schedule 12 – Appendix and Schedule 12 – Appendix A to update annual cost responsibility assignments for Regional Facilities, Necessary Lower Voltage Facilities and Lower Voltage Facilities consistent with PJM Tariff, Schedule 12.
Effective: PJM requested the revisions be effective as of January 1, 2022.



12.3.2021 | at FERC | by PJM
On December 3, 2021, in Docket No.ER22-548-000, PJM submitted proposed revisions to PJM Tariff, section 36.1A and PJM Tariff, Attachment O to remove inconsistencies associated with administrative timelines related to status changes for a facility to operate as a Generation Capacity Resource or Behind the Meter Generation.
Effective: PJM requested the revisions be effective as of February 2, 2022.



10.8.2021 | at FERC | by PJM
On October 8, 2021, in Docket No. ER21-2774-001, PJM submitted an amendment to its August 26, 2021 filing of Tariff revisions to revise cost allocation responsibility for certain baseline upgrades included in the update to the Regional Transmission Expansion Plan approved by the PJM Board of Managers on July 29, 2021 (August 26 Filing). The amendment seeks to correct an error in the upgrade description for baseline upgrade b3317.
Effective: PJM requested an effective date of November 24, 2021, which is consistent with the effective date requested in the August 26 Filing.

On October 7, 2021, in Docket No. ER19-2105-005, PJM submitted, on behalf of settling parties, a settlement agreement that resolves comprehensively all issues set for hearing regarding the rate for Point-to-Point transmission service at the Border of PJM for delivery to neighboring regions (Border Rate).
Effective: The Border Rate settlement includes revisions to Tariff, Schedule 7, to be implemented effective January 1, 2020.

On October 4, 2021, in Docket No. ER22-26-000, PJM submitted corrected versions of the Excel files for Attachment E to the October 1, 2021 filing of proposed revisions to the Tariff to update the manner in which PJM recovers its administrative costs to better ensure both rate equity among PJM’s Service Categories and revenue adequacy.

On October 1, 2021, in Docket No. ER22-26-000, PJM proposed revisions to the Tariff to update the manner in which PJM recovers its administrative costs to better ensure both rate equity among PJM’s Service Categories and revenue adequacy.
Effective: PJM proposes to change its administrative cost recovery from the current practice of initial charges at stated rate levels with a varying quarterly refund that reduces each customer’s effective rate, to a new practice of monthly rates based on that month’s costs and that month’s billing determinants. PJM requests Commission action by December 1, 2021, and for the Tariff revisions to become effective January 1, 2022.

On November 29, 2021, in Docket No. ER22-486-000, PJM filed non-substantive, clerical, ministerial, and substantive revisions to the PJM Tariff and PJM Operating Agreement to correct, clarify, and/or make consistent certain provisions approved through the GDECs subcommittee process.
Effective: PJM requested an effective date of January 29, 2022 for the proposed revisions.



11.24.2021 | at FERC | by PJM
On November 24, 2022, in Docket No. ER22-475-000, PJM submitted proposed revisions to the PJM Operating Agreement, Schedule 12 and the RAA, Schedule 17, to reflect the permanent termination of Switch Energy, LLC (Switch) as a PJM Member in accordance with Operating Agreement, section 15.1.6 (c) and 4.1 (c), because Switch failed to make payments when due twice during a 12 month period.
Effective: PJM requested the revisions be effective as of January 24, 2022.

On November 18, 2021, in Docket No. ER22-429-000, PJM submitted a filing with proposed revisions to the PJM Tariff, Definitions I through N and PJM Operating Agreement, Definitions I through N definitions of No-load Cost and Incremental Energy Offer.

On November 8. 2021, in Docket No. ER22-358-000, PJM submitted on behalf of Public Service Electric and Gas Company (PSE&G), in its role as Chair of the Transmission Owners Agreement Administrative Committee, amendments to the Consolidated Transmission Owners Agreement, Rate Schedule FERC No. 42, sections 8.4.3, 8.4.4, 8.5.1, and 8.5.2 that were approved on October 21, 2021.
Effective: PSE&G requested that the amendments to the Consolidated Transmission Owners Agreement become effective as of January 10, 2022.



9.29.2021 | at FERC | by PJM
On September 29, 2021, in Docket Nos. ER21-2965-000, and ER21-2965-001, PJM submitted on behalf of Atlantic City Electric Company (ACE), Delmarva Power & Light Company (Delmarva), and PECO Energy Company (PECO) revisions to Attachments H-1A (ACE), H-3D (Delmarva), and H-7A (PECO) of the PJM Open Access Transmission Tariff (OATT). The amendments modify the respective ACE, Delmarva, and PECO formulas rates to revise the Transmission Wages and Salary (W&S) Allocator to include labor from their affiliated Exelon utility services companies.
Effective: ACE, Delmarva and PECO are requesting that the revisions to Att. H-1A, H-3D and H-7A be effective as of January 1, 2022.

On September 29, 2021, in Docket Nos. ER21-2965-000, and ER21-2965-001, PJM submitted on behalf of Atlantic City Electric Company (ACE), Delmarva Power & Light Company (Delmarva), and PECO Energy Company (PECO) revisions to Attachments H-1A (ACE), H-3D (Delmarva), and H-7A (PECO) of the PJM Open Access Transmission Tariff (OATT). On September 9, 2021, in Docket No. ER21-1635-002, PJM filed revisions to the PJM Tariff, Schedule 6A, concerning Black Start Service in compliance with the order issued by the Commission on August 10, 2021, in Docket No. ER21-1635-000 (August 10 Order). In the August 10 Order, the Commission accepted the PJM’s Black Start Filing submitted on April 7, 2021. Specifically, the Commission accepted the April 7 Filing’s proposed revisions to certain non-rate terms and conditions for Black Start Service, accepted the change to the Minimum Tank Suction Level (MTSL) calculation subject to PJM correcting typographical errors in that calculation, and accepted the proposed Tariff revisions for the Capital Recovery Factor (CRF) for new Black Start Units (units committed after June 6, 2021) subject to this compliance filing.



6.30.2021 | at FERC | by PJM
On June 30, 2021, in Docket No. ER21-2282-000, PJM submitted, on behalf of the PJM Transmission Owners, proposed revisions to the PJM Tariff, consisting of new Tariff, Section 217.8 and a new pro forma Network Upgrade Funding Agreement (Tariff, Attachment O-2), to provide Transmission Owners with the option to elect to fund the capital cost of Network Upgrades necessary to accommodate generator interconnections.
Effective: The PJM Transmission Owners request that the proposed revisions to the PJM Tariff be effective as of August 30, 2021.



4.30.2021 | at FERC | by PJM
On April 30, 2021, in Docket No. ER21-1802-000, PJM filed proposed revisions to PJM Tariff, Attachment K-Appendix, section 3.2.3(f), and to the identical corresponding provision in the PJM Operating Agreement, Schedule 1, section 3.2.3(f) to effectuate the single rate component of a reform package related to PJM’s process for generation stability limits. The PJM Tariff and PJM Operating Agreement revisions limit the ability of a generation resource to seek lost opportunity cost credits when honoring a generation stability limit.
Effective: PJM requested a June 1, 2022 effective date for the proposed revisions.



4.7.2021 | at FERC | by PJM
On April 7, 2021, PJM filed, in Docket No. ER21-1635-000, proposed revisions to PJM Tariff, Schedule 6A to clarify and rationalize the requirements for Black Start Units, including testing requirements, substitution provisions, involuntary termination rules, and the Minimum Tank Suction Level or MTSL calculation. In addition, PJM proposed Tariff revisions to provide for transparency and annual updates to the Capital Recovery Factor (CRF) component of Black Start Service payments for units that require new or additional capital investment, and a commitment period for Black Start Units electing to recover new or additional Black Start Capital Costs based on the life of the Black Start Equipment. The CRF and lifetime commitment revisions will apply only to Black Start Units selected after the effective date of the Tariff changes.
Effective: PJM requested a June 6, 2021, effective date for the proposed Tariff revisions.

On March 22, 2021, in Docket No. ER21-726-001, PJM submitted a response to the Commission’s February 18, 2021 deficiency notice regarding PJM’s December 23, 2020 filing of amendments to Schedule 12-Appendix and Schedule 12-Appendix A of the PJM Tariff to provide updated annual cost allocations for Regional Facilities and Necessary Lower Voltage Facilities included in the PJM RTEP.
Effective: PJM requested the revisions be effective as of January 1, 2021.



3.1.2021 | at FERC | by PJM
On March 1, 2021, in Docket No. ER21-278-001, PJM submitted responses to the Commission’s December 22, 2020 deficiency letter regarding PJM’s FPA section 205 filing to establish an Effective Load Carrying Capability (ELCC) construct for determining the relative amount of capacity that variable, limited duration, and combination resources may offer in PJM.
Effective: PJM requested an effective date of July 1, 2021 for the RAA and Tariff revisions, and an order on the revisions by May 1, 2021. In accordance with section 388.112 of the Commission’s regulations, PJM has requested confidential treatment for certain data provided in an appendix to the responses, and the confidential data will be made available to participants in this proceeding upon their execution of the Protective Agreement PJM included with the filing.

On December 23, 2020, in Docket No. ER21-726-000, PJM submitted for filing revisions to the PJM Tariff, Schedule 12 – Appendix and Schedule 12 – Appendix A to update annual cost responsibility assignments for Regional Facilities, Necessary Lower Voltage Facilities and Lower Voltage Facilities consistent with PJM Tariff, Schedule 12.
Effective: PJM requested the revisions be effective as of January 1, 2021.



11.23.2020 | at FERC | by PJM
On November 23, 2020, in Docket Nos. EL20-56-000 & ER21-460-000, PJM submitted revisions to the PJM Tariff and PJM Operating Agreement pertaining to Station Power service, as directed by the Commission in a September 17, 2020 Order addressing a complaint and petition for declaratory order on the Station Power provisions, and opening an investigation under Federal Power Act, section 206.
Effective: As directed, PJM is requesting an effective date of September 23, 2020.

On October 31, 2019, in Docket No. ER20-250-000, PJM submitted for filing proposed revisions to the PJM Operating Agreement, Schedule 12, and the RAA, Schedule 17, to (i) add the new members, (ii) remove withdrawn members, (iii) reflect the signatories to the RAA, and (iv) reflect members’ whose corporate names changed during the third quarter of 2019.
Effective: PJM requested September 30, 2019.

On October 7, 2019, in Docket Nos. EL19-61-000 and ER20-45-000, PJM submitted in compliance with the Commission’s August 30, 2019 order instituting Federal Power Act, section 206 proceeding (Order to Show Cause) revisions to the PJM Operating Agreement, Schedule 6, sections 1.5.8(c) and (o). In addition, PJM sought additional guidance on the treatment of transmission owners’ asset management criteria within the PJM Form No. 715 planning process as a result of both the Order to Show Cause and the Commission’s Order on Remand issued August 30, 2019 in Docket Nos. ER15-1387-004 and ER15-1344-005.

On October 3, 2019, in Docket No. ER20-34-000, PJM and the Midcontinent Independent System Operator, Inc. On January 5, 2018, in Docket No. ER18-614-000, PJM submitted for filing revisions to the PJM Tariff, Schedule 12-Appendix A to incorporate cost responsibility assignments for new baseline upgrades included in the recent update to the Regional Transmission Expansion Plan approved by the PJM Board of Managers on December 6, 2017, including its first interregional transmission projects (Targeted Market Efficiency Projects) between PJM and Midcontinent Independent System Operator, Inc. under the MISO-PJM Joint Operating Agreement. PJM requests the revisions become effective on April 5, 2018, which is 90 days after the date of this filing to allow a 30 day comment period.

On October 25, 2017, in Docket No. ER18-87-001, PJM submitted an errata filing to correct proposed revisions in PJM Tariff, Attachment K-Appendix, section 3.2.2(h), 3.2.2(l) and 3.2.2A.1(b)(i) and the parallel sections of Operating Agreement, Schedule 1. These revisions were inadvertently omitted from PJM's October 17, 2017 filing regarding improvements to the performance of the PJM Regulation market.
Effective: PJM is requesting April 1, 2018.

The following compliance filings are still pending FERC approval. Pending language is shown in italics in the conformed governing agreement posted on PJM’s website.

10.22.2021 | at FERC | by PJM
On October 22, 2021, in Docket No. ER21-2524-001, PJM filed an errata to PJM’s July 27, 2021 compliance filing (July 27 Filing) to amend revisions to the PJM Tariff, section 4.2 submitted to comply with Order No. 676-I. In Order No. 676-I, the Commission amended its regulations to incorporate by reference, with certain exceptions, the NAESB WEQ Version 003.2 Standards. In this errata filing, PJM seeks align the PJM Tariff changes included in the July 27 Filing with the Commission’s revisions to the regulatory text pursuant to an Errata Notice issued by the Commission on March 3, 2020.
Effective: PJM requests the effective date of the proposed Tariff revisions be changed from October 27, 2021, to an indeterminate effective date (12/31/9998) for the Tariff record.



10.4.2021 | at FERC | by PJM
On October 4, 2021, in Docket Nos. EL19-47-000, EL19-63-000, and ER21-2877-001, PJM submitted a compliance filing to amend various sections of Tariff, Attachment DD in accordance with FERC's September 2, 2021 order establishing a replacement Market Seller Offer Cap.
Effective: PJM is requesting that the revisions to Tariff, Attachment DD be effective as of September 2, 2021.



9.17.2021 | at FERC | by PJM
On September 17, 2021, in Docket No. ER20-227-004, PJM submitted on behalf of Jersey Central Power & Light Company (JCP&L), a non-substantive refiling of the clean tariff records for Attachments H-4 and H-4B to the PJM Open Access Transmission Tariff to correct a XML coding error in the previously-submitted versions of these attachments included with JCP&L’s May 14, 2021 compliance filing implementing an uncontested settlement previously approved by the Commission. No substantive changes to Attachments H-4 and H-4B were made with this amendment, which only impacts the manner in which the tariff records are displayed in the FERC eTariff viewer.
Effective: JCP&L requested that the Commission establish an expedited seven-day notice period for this amendment and that the refiled tariff sheets become effective as of January 1, 2020, consistent with the Commission’s prior order in this docket approving the parties’ uncontested settlement.



9.1.2021 | at FERC | by PJM
On September 1, 2021, in Docket No. ER13-198-008, PJM submitted an updated compliance filing submitted to comply with the requirements of Order No. 1000. The limited proposed updates to PJM’s earlier compliance filings are to clarify the meaning of ambiguous provisions and ensure consistency throughout Operating Agreement, Schedule 6, section 1.5.8.
Effective: PJM requested an effective date of November 1, 2021.



8.30.2021 | at FERC | by PJM
On August 30, 2021, in Docket No. ER19-2722-006, PJM filed an update to the July 16, 2021 compliance filing to comply with the Commission’s June 22, 2021 order, to establish an effective date of September 1, 2021, for the implementation of the fast-start pricing revisions to the PJM Tariff and Operating Agreement.

On July 30, 2021, in Docket No. ER21-1844-001, PJM submitted a compliance filing with proposed revisions to Tariff, Attachment DD, section 6.8(a) pursuant to the directive contained within the July 2, 2021 Order. The purpose of this compliance filing is to include the formula for calculating the Capital Recovery Factor into the Tariff.

On July 30, 2021, in Docket No. ER21-2564-000, The Dayton Power and Light Company (DP&L), through PJM as tariff administrator, filed a compliance filing in accordance with FERC's Order of July 15, 2021 in Docket No. ER20-1068-000. With the compliance filing, DP&L included revisions to PJM Tariff, Attachment H-15A to remove a cover page which was inadvertently included in a previous filing.
Effective: DP&L requested an effective date of October 3, 2020.



7.27.2021 | at FERC | by PJM
On July 27, 2021, in Docket No. ER21-2524-000, PJM submitted revisions to PJM Tariff, section 4.2 in compliance with the February 4, 2020 Final Rule issued by the Commission in Docket No. RM05-5-027. PJM (i) incorporates by reference the latest version of the Standards for Business Practices and Communication Protocols for Public Utilities (“Business Practice Standards”) adopted by the Wholesale Electric Quadrant (“WEQ”) of the North American Energy Standards Board (“NAESB”); (ii) requests a continued waiver of certain WEQ NAESB Business Practice Standards previously granted by the Commission; and (3) requests new waivers of WEQ NAESB Business Practice Standards that are newly proposed in version 3.2.
Effective: PJM requested an October 27, 2021 effective date for the revisions.



7.19.2021 | at FERC | by PJM
On July 19, 2021, in Docket No. ER17-1433-003, PJM filed proposed revisions to the Tariff and Operating Agreement related to the Financial Transmission Rights (FTR) forfeiture rule, in compliance with the Commission’s May 20, 2021 order in the same proceeding. In its filing, PJM proposed a revised approach to triggering forfeiture of applicable FTR-related revenues when appropriate, and provided additional related information requested by the Commission.



2.3.2021 | at FERC | by PJM
On February 3, 2021, in Docket Nos. EL16-49, ER18-1314-000 and EL18-178-000, PJM submitted, in accordance with the Commission’s January 19, 2021 order, a compliance filing removing the sentence in Tariff, Attachment DD, section 5.14(h-1)(2) that specifies that the Sell Offer for a Capacity Resource with State Subsidy should be the resource-specific floor price in the event the MOPR Floor Offer Price is greater than the applicable Market Seller Offer Cap.
Effective: An effective date of October 15, 2020 was requested.

On October 30, 2020, in Docket No. ER21-278-000, PJM submitted proposed revisions to the PJM Tariff and the RAA to establish an Effective Load Carrying Capability (ELCC) construct for determining the relative amount of capacity that variable, limited duration, and combination resources may offer in PJM’s capacity market (known as the Reliability Pricing Model or RPM) or provide in a Fixed Resource Requirement (FRR) capacity plan. Effective: PJM requested an effective date of June 1, 2021.



5.28.2020 | at FERC | by PJM
On May 28, 2020, in Docket No. ER19-2722-001, PJM submitted an errata to the pending compliance filing pertaining to fast-start pricing practices submitted on August 30, 2019. PJM recently discovered a minor, one-word error in the proposed PJM Tariff and Operating Agreement language contained within the August 30 compliance filing and is correcting the error in this errata filing.



8.30.2019 | at FERC | by PJM
On August 30, 2019, in Docket No. ER19-2722-000, PJM submitted its filing in compliance with the April 18, 2019 Order concerning fast-start pricing in the PJM region. PJM indicated that it would await a Commission acceptance of the proposed rules before implementation. Upon Commission acceptance PJM will diligently implement this filing, including any Commission changes, and will submit an informational report providing notice to the Commission and stakeholders of the intended implementation date.



7.30.2018 | at FERC | by PJM
On July 30, 2018, in Docket No. ER18-2102-000 and -001, PJM submitted in compliance with the Commission’s May 31, 2018 Order on Contested Settlement approving the Settling Parties Settlement Agreement and Offer of Settlement (Settlement), which resolved outstanding cost allocation issues relative to Regional Facilities approved by the PJM Board of Managers prior to February 1, 2013, amendments to the PJM Tariff (“Tariff”) to add pro forma tariff records to include a new Schedule 12-C, including Appendices A through C, as well to revise cost responsibility assignments for Covered Transmission Enhancements detailed in Schedule 12-C Appendix A consistent with the terms of the Settlement.
Effective: PJM is requesting January 1, 2016, consistent with the May 31 Order.

Amendments Accepted by FERC

Currently Effective

The following governing agreement amendment filings were submitted to, and accepted by, FERC, and are currently effective but are not yet reflected in the version of the governing agreement posted on PJM’s website. The amendments can be found in the filing submitted to FERC and will be added to the conformed governing agreement after PJM submits a clean-up filing, which is accepted by FERC, to incorporate the amendments.

2.16.2021 | at FERC | by PJM
On February 16, 2021, in Docket No. ER19-2722-003, PJM submitted its filing in compliance with the December 17, 2020 Order on PJM’s August 30, 2019 compliance filing to implement fast-start pricing in the PJM region. PJM requested an effective date of May 1, 2021, or the first day of the first month following a Commission order accepting the enclosed revisions, pending system conditions.
Effective: Because PJM requires at least 15 days’ lead time from the date of the order to ensure the software changes are in place, for a May 1, 2021 effective date, PJM requests that the Commission issue an order no later than April 16, 2021.
